Announcing the 2008 Creating Keepsakes Scrapbooker of the Year Contest
Win the biggest contest in scrapbooking, and you could be the next Scrapbooker of the Year! The winner will receive $10,000 in cash and an exclusive two-year contract with Creating Keepsakes, plus additional prizes. Plus, five finalists will receive an all-expense-paid trip to CKU–Provo along with a prize package.
Entering Is Easy
1. Submit a portfolio (up to 13" x 13" in size) of your 20 best scrapbook projects in one of the following two ways: (1) print computer scans or photos or (2) make color copies. Do not send original layouts or projects; we are unable to return materials. Eighteen (18) of the projects must be layouts, and the remaining two (2) can be layouts or other projects related to memory-keeping.
2. Prepare an article outline on a scrapbooking topic relevant to Creating Keepsakes readers. The article should reference one of the layouts or projects from your entry. Include an introductory paragraph (75–100 words) and a bulleted outline of the points you would describe in the article. Each bullet should contain at least one sentence discussing the bulleted idea.
3. Prepare a separate sheet (or sheets) of paper that includes your name, contact information (including phone number, address, e-mail address and alternate contact information) and a list of supplies you used to create your 20 projects.
4. Send everything from steps 1, 2 and 3, to: Scrapbooker of the Year Contest Creating Keepsakes Magazine 14850 Pony Express Rd. Bluffdale, UT 84065 All entries must be received by May 29, 2008.
**Note: There is no entry form required for the 2008 Scrapbooker of the Year contest. Creating Keepsakes apologizes for the confusion.**
Official Rules NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASING WILL NOT INCREASE YOUR ODDS OF WINNING. VOID WHERE PROHIBITED. YOU DO NOT NEED TO BE PRESENT TO WIN. 1. The 2008 Scrapbooker of the Year Contest (“Contest”) is open to all who are legal residents of the United States and the District of Columbia and located in the U.S. or D.C. at the time of entry, and Canada (excluding Quebec) (all references to Canada hereinafter are defined as excluding Quebec), including contributors to Creating Keepsakes magazine and winners of previous contests sponsored by Creating Keepsakes magazine, except winners of previous Scrapbooker of the Year Contests. Notwithstanding the foregoing, legal residents of Puerto Rico and other U.S. territories, trust territories and possessions are excluded from participation in the Contest. Entrants under 18 years of age must have a parent or legal guardian’s permission to enter this Contest.
By entering the Contest, entrants (and if under age 18, their parents/legal guardians) agree to accept and be bound by all terms of these official rules (“Official Rules”). This Contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited. Employees of Creating Keepsakes magazine (“Sponsor” or “Creating Keepsakes”), CKMedia Inc., their respective parents, subsidiaries, affiliates, advertising and promotion agencies (collectively, “CK Media”), their immediate family members and/or those living in the same household are not eligible to enter. The Contest begins 5/1/08 and ends 5/29/08.
2. To enter, please complete the following: (i) Submit a portfolio (up to 13" x 13" in size) of your 20 best scrapbook projects in one of the following two ways: (1) print computer scans or photos or (2) make color copies. For the purposes of this Contest, a “Layout” is a one- or two-page scrapbook Layout that conveys a single theme. Twelve of the Layouts must be Non-published. A Layout is Non-published if it has not been posted in any public forum including having been posted in any online forum. Full-sized or reduced copies or photographs of Layouts are acceptable. Multiple photos or copies of projects can be included to show all aspects of the projects.
If affixing color copies, photos or printed scans to sheets of paper or cardstock, do so by applying ADHESIVE DOTS to all four corners of the backs (unselected, unpublished Layouts will be separated after judging to be considered for use in the magazine and future special issues). Please DO NOT use photo corners, staples or a glue stick to adhere your entry to cardstock.
(ii) Prepare an article outline on a scrapbooking topic relevant to Creating Keepsakes readers. The article should reference one of the Layouts or projects from your entry. All entries must be received by May 29, 2008.
(v) Creating Keepsakes is not responsible for lost, incomplete, illegible, late, or misdirected entries, inaccurate entry information, hardware, software, or other technical malfunctions of any kind. Creating Keepsakes reserves the right, in its sole discretion, to void any and all entries of an entrant who Creating Keepsakes believes has attempted to tamper with or impair the administration, security, fairness, or proper play of this Contest or to adjust the dates herein or cancel the Contest or if a computer virus or other cause beyond Creating Keepsakes’ control corrupts the administration, proper play or security of this Contest. Creating Keepsakes reserves the right, in its sole discretion, to change these Official Rules.
3. Twelve (12) of the Layouts cannot currently be or have ever been posted in any online forum, submitted to Creating Keepsakes or any other magazine, created for a specific manufacturer, or entered in any other Contest.
4. The entrant must be the author of all Layouts submitted, except as otherwise provided. Layouts must also be original to the author and exclusive of any material created by a third party or otherwise aided by a third party. However, photographs taken by someone other than the entrant may be used if clearly marked with the following statement next to the Layout: “Photo(s) not taken by entrant.” Stock photos must also be accompanied with a credit to the photo source. All photo editing must be work that is original to the entrant.
5. Five (5) finalists (“Finalists”) will be selected based on the entries submitted according to the requirements listed in #’s 2–4 above. Finalists will be notified on or about 6/27/08.
To be eligible for consideration for the title of 2008 Scrapbooker of the Year, Finalists will be required to participate in additional assignments as determined by Creating Keepsakes in its sole discretion, including but not limited to a personal telephone interview, a personal profile form and a make-and-take project with step-by-step instructions. Finalists’ interviews will be scheduled before 7/8/08. Entrants will be required to answer a set of questions, 50% of which will be provided to the entrant prior to the interview. Creating Keepsakes reserves the right to change these additional assignments at any time.
6. All initial entries will be judged blind. The Finalists’ additional assignments will be judged blind as appropriate based on the nature of the assignment. Creating Keepsakes will determine on a case by case basis which additional assignments will be judged blind. Creating Keepsakes will select Finalists based on the following criteria:
Did the entrant accurately complete each of the Contest entry requirements?
Does the entrant use design principles to create a balanced Layout with elements that support the theme of the page?
Does the entrant have a clear, distinct style?
Does the entrant present innovative principles, approaches or techniques?
Does the entrant express himself or herself well on the article portion of the entry?
Does the entrant provide interesting and memorable information in the article portion of the entry?
In addition, Creating Keepsakes will select one (1) winner (“Winner”) for the title of 2008 Scrapbooker of the Year from the Finalists based on the following criteria:
Does the Finalist express himself or herself well in the personal interview?
Does the Finalist express in the interview viable ideas in and a sufficient understanding of the scrapbooking industry?
Does the Finalist exhibit and instill in others an enthusiasm for scrapbooking?
Does the Finalist understand and know how to solve the challenges of typical scrapbookers?
Does the Finalist exhibit an understanding of and ability to perform the duties of Scrapbooker of the Year?
If the judging results in a tie, tied entries will be re-assessed on the factors listed above. If the second assessment still does not break the tie, the tied entries will be treated the same by Creating Keepsakes and will either all be Finalists or all be rejected. However, in determining the Winner, Creating Keepsakes will continue to re-assess each entry on the factors listed above or add additional assignments until Creating Keepsakes determines the Winner. The Contest will take place under the supervision of Creating Keepsakes magazine. Finalists and the Winner will be selected based on the criteria and requirements listed in these rules by a qualified panel of judges (“Judges”) comprised of individuals with significant industry experience as determined by Creating Keepsakes. The Judges’ decisions are final on all matters relating to this Contest.
Finalists will be notified by phone on or about 6/27/08. Winner will be notified by phone or in person on or around 8/8/08. 7. Five (5) Finalists will be selected based on the criteria listed above, from which one (1) Winner will be selected based on the criteria listed above. The Winner will receive a cash prize of $10,000, a prize package of scrapbooking products and an exclusive two-year contract with Creating Keepsakes (collectively, “Winner’s Prize Package”). Each Finalist will be awarded an all-expenses-paid trip (“Trip”) to CKU–Provo (8/6/08–8/9/08), a cash prize of $100 and a prize package from our sponsors (collectively, “Prize” or “Prizes”). The Trip includes: round-trip coach class airfare for Finalist from a major commercial airport near the Finalist’s residence (Approximate Retail Value (“ARV”) $500 per person but in no event more than $700 per person); and three (3) nights’ single occupancy hotel accommodations at the Provo Marriott Hotel in Provo, Utah, or a different hotel that Creating Keepsakes shall determine (ARV $340 per person) (total ARV not to exceed $400 per person). Creating Keepsakes will reimburse each Finalist up to a total of $100 for ground travel to and from the airport. Any unspecified expenses including, but not limited to, incidental hotel expenses, meals and gratuities are the sole responsibility of the Finalist. The total ARV of the Prize is approximately $1,500 at the time these rules were posted. To the extent a Finalist elects to bring one or more guests at the Finalist’s sole expense and cost, any guests of a Finalist may be a minor only if the Finalist is guest’s parent or legal guardian. Guests of the Finalist must sign a release of liability. If any of Finalist’s guests are minors, the Finalist must sign a release. Finalist and guests are solely responsible for obtaining all necessary travel documents. All travel arrangements are subject to availability. Airline tickets, once issued, are non-transferable, non-changeable, non-refundable and may not be re-sold. Airline tickets will be electronically issued. Creating Keepsakes is not responsible to provide any formal confirmation of travel. In the event a Finalist cannot accept the Trip, the Finalist will not be subject to disqualification but will forfeit this portion of the Prize. However, the Trip is non-transferable and non-exchangeable for cash. Submitting an entry does not mean that you have won a Prize. Odds of winning depend upon the total number of eligible entries in the Contest. It is expressly understood that Sponsor is under no obligation to the Finalists and Winner other than as expressly set forth herein. The Prize is awarded to each Finalist and Winner “AS IS” and WITHOUT WARRANTY OF ANY KIND, expressed or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose), except for any manufacturer warranty.
No substitution of any Prize will be permitted except by Sponsor, who may substitute a Prize of equal or greater value if an advertised Prize becomes unavailable. The Prize is non-transferable, and the prize package may not be redeemed for cash, unless it is a cash prize. The Finalists and Winner are solely responsible for all federal, state and local taxes and fees associated with the receipt of any Prize.
8. All entries and requests become the exclusive property of Sponsor and will not be acknowledged or returned, or any portion thereof. Sponsor will have the right to photograph the Finalists and Winner. Entry constitutes permission to use the Finalists’ and Winner’s name, picture, likeness, entry, or any portion thereof, and city and state of residence for purposes of trade, publicity or promotion for no additional compensation except where prohibited by law. All entries must be original, entrants may not have won previous Scrapbooker of the Year contests, and twelve (12) of the Layouts/projects must not have been previously been seen (in full or in part) on any websites or in any publications or created for a manufacturer or entered in a contest. Submission of entry constitutes entrant’s consent (or that of their parent/legal guardian) to irrevocably assign to Sponsor any and all rights to entry including, but not limited to, intellectual property rights. The entrant represents and warrants that he/she holds the necessary rights to irrevocably assign all rights in the entry, including necessary rights related to copyrights, patents, trademarks, trade secrets, music, images or other proprietary or property right, or any other right of any person or entity and that the entry does not infringe on any third-party rights. (DO NOT COPY THE WORKS OF OTHERS OR INCLUDE OTHER PERSONS OR THEIR PROPERTY IN YOUR ENTRY WITHOUT FIRST OBTAINING THEIR WRITTEN CONSENT.) Submission of any entry grants Sponsor and its agents the right to publish, produce, use, adapt, edit and/or modify the entry in any way and in any and all media, without limitation and without compensation to the entrant. Entrant hereby agrees to indemnify Creating Keepsakes and CK Media (collectively, “CK”) and shall defend CK against, and hold CK harmless from, all claims, liabilities and obligations (including reasonable attorneys’ fees and costs) (“Claims”) brought by a third party against CK arising out of the infringement or misappropriation of any copyrights, trade secrets, or trademarks of any third party. CK agrees to provide entrant with prompt written notice upon becoming aware of any such claim. Entrant shall undertake and conduct the defense of any such claim and CK shall reasonably cooperate with entrant in the defense of such claim. Entrant shall reimburse CK for all reasonable out-of-pocket costs incurred by CK in connection with such cooperation. CK shall have the right to participate in any action at its own expense.
9. The Finalists and Winner (or the parent/guardian if Finalist/Winner is a minor) will be required to execute an affidavit of eligibility, compliance with Contest rules and release of liability. All Finalists and the Winner will also be asked to sign a confidentiality agreement until their names and Layouts are released to the public by Creating Keepsakes.
10. All entrants release Sponsors, its affiliates, parents, subsidiaries, directors, officers, shareholders, representatives, successors, assigns, licensees, employees, and agents, and all others associated with the development and execution of this from any and all liability from injury, loss or damage of any kind, including any personal injury, death, loss or damage of any kind or claims based on publicity rights, defamation, or invasion of privacy resulting from participation in this Contest or acceptance or use of the Prize awarded whether under a theory of contract, tort (including negligence), warranty or other theory.
Use of Sponsor’s website is at entrant’s own risk. Sponsor is not responsible for any personal injury or property damage or losses of any kind which may be sustained to entrant’s or any other person’s computer equipment resulting from participation in the Contest, use of the Sponsor’s website or the download of any information from Sponsor’s website.
Entrant further agrees that all rights under Section 1542 of the California Civil Code, and any similar law of any state or territory of the United States, are hereby expressly waived. That section, in pertinent part, provides: “A general release does not extend to claims which the Creditor does not know or suspect to exist in his favor at the time of the executing of this release, which if known by him must materially affect his settlement with the debtor.” Any dispute shall be resolved individually without resort to any form of class action.
11. Prizes must be claimed by 8/22/08. Failure to execute and return any requested document within fourteen (14) days of postmark, or return of notification or Prize as undeliverable may result in forfeiture of Prize. An alternate potential winner may be selected at the sole discretion of Sponsor. All reasonable efforts will be made to contact the Finalists and Winner.
12. Void where prohibited or restricted by law. All federal, state and local laws and regulations apply.
13. US and Canadian entrants:
(i) If you are a legal resident in the United States or Canada and are under the applicable age of majority, then your parent or legal guardian must also print their name and sign the back of each submission below your signature. They will also be required to provide parental permission and releases on your behalf. Selected Canadian entrants must correctly answer, without assistance of any kind, a time-limited, mathematical skill-testing question to be declared a Finalist/Winner. US and Canadian Finalists/Winner (or the parent/guardian if a minor) will be required to execute an affidavit attesting to entry eligibility, compliance with these Official Rules, and release of liability as may be applicable.
(ii) To remain eligible, each entrant must not disclose their selection as a Finalist or Winner until the Sponsor publishes the list of Finalists and the Winner. If Creating Keepsakes determines in its sole discretion that the entrant breached this confidentiality requirement, the entrant becomes subject to disqualification. In addition, the Finalists and the Winner will be asked to sign a confidentiality agreement upon notification as well, agreeing not disclose their selection as a Finalist or Winner until the Sponsor publishes the list of Finalists and the Winner.
(iii) Failure to execute and return any requested document within fourteen (14) days of receipt may result in forfeiture of Prize, in which case an alternate potential finalist/winner may be selected at the sole discretion of Sponsor.
14. One entry per person. If any person submits multiple entries, Sponsor will enter only one (1) entry into the Contest (the first entry Sponsor receives). Mailed entries must be received in the Creating Keepsakes offices by no later than 5:00 p.m. MST on Thursday, 5/29/08. Any entries not received as outlined will not be eligible for the 2008 Scrapbooker of the Year Contest (no exceptions). Creating Keepsakes cannot accept late entries due to delays in shipping or due to technical errors or power outages. Sponsor shall not be responsible for lost, late, mutilated or misdirected entries.
15. Entries that do not follow the prescribed entry requirement or that do not follow the Official Rules will automatically be disqualified from the 2008 Scrapbooker of the Year Contest, although the Layouts may be eligible for use by Creating Keepsakes in its publications. Disqualified entrants will be required to return the cash prize, Prizes and Winner’s Prize Package to Sponsor and give up all rights to the title of Scrapbooker of the Year Finalist/Winner, including the exclusive contract with Creating Keepsakes. In the event that a winning entrant is disqualified after the announcement of Finalists/Winner is made, his or her position as a Scrapbooker of the Year finalist/winner may not be filled, at Creating Keepsakes’ sole discretion.
16. The Official Rules shall be governed by the laws of the state of Utah.
Clarification Addendum
We decided to clarify our rules to make the Contest open to US military families living abroad. Creating Keepsakes fully supports the military and our troops and families, including those stationed overseas and therefore will allow entries to come from them as long as they fully comply with the Official Rules, including recognizing that it is their responsibility to comply with all applicable federal, state, and local laws and regulations and that they are solely responsible for all federal, state and local taxes and fees associated with the receipt of any Prize.
